Negative Reactions Mystify Electronic Cigarette Owners By Kristin Noll-Marsh The booth at the Wisconsin State Fair Expo was black with big, gold lettering exclaiming, "Electronic Cigarettes - The Smoking Alternative!" Initially, I found the concept of electronic smoking laughable, as would most tobacco users. However, after dragging my husband over to the booth for a look, it only took us a moment to realize that this was a truly revolutionary invention. Surprisingly, the price was reasonable, too! The vendor made it clear that it was not intended as a smoking cessation device, only a much safer and cheaper way to smoke. To date, there is no scientific proof that they are safer, but it didn't take a degree in rocket science to see that the absence of smoke, tar and a few thousand other ingredients - including the 60-70 known carcinogens and poisons found in tobacco - made the flavored nicotine liquid seem tame by comparison. Moreover, the ability to reduce the nicotine levels from high, medium and low to liquid containing no nicotine whatsoever was an appealing way to wean off nicotine altogether. Of course, as soon as I got our new devices home, I had to log online to see what I could find out about them. The first thing I found was a wide range of different devices and liquids available and not all devices are created equal. Additionally, I found that a whole subculture has quickly built up around the new phenomenon of "vaping," the term coined by electronic cigarette owners to differentiate it from tobacco smoking. The electronic cigarette is known as a personal vaporizer, as it produces a fine mist or vapor, similar to the steam from a cup of hot coffee. Tobacco cigarettes are amusingly called "analogs." Personal vaporizer owners who have quit using tobacco cigarettes proudly consider themselves non-smokers. "I feel free of cigarettes for the first time in my life," said James Solie, of Hudson, WI. Solie said his life has changed in so many ways since he has quit smoking. "I used to go to bed at night and could smell the smoke on myself, and it wasn't good. I don't miss that. I just feel better in every way imaginable. I breathe better, don't have that nasty congestion in the morning. My throat feels better. My sense of smell, thus taste, is much better." Solie added that his wife is happy that he has quit smoking, as well. The fact that personal vaporizer owners are no longer smoking is difficult for non-smokers and smoke-free advocates to understand, because vapor looks similar in appearance to smoke. Thus many advocates welcomed recent news of the FDA's proposed ban on certain electronic cigarettes, due to safety concerns, and proposed bans on their use in public spaces in municipalities in New York, Connecticut and Oregon. Vaporizer owners fear the public has been falsely led to believe that personal vaporizers aren't any different than tobacco cigarettes. "Because vaping looks like smoking people immediately associate the two and come to a bad conclusion," said Scott Brower, of Santa Clarita, CA. Brower said he was an occasional pipe and cigar tobacco smoker, but now enjoys only nicotine-free electronic pipes and cigars. "They need to be educated to understand the fundamental differences." On the FDA report, Brower said, "The announcement was rushed and omitted critical details. What should have been a scientific process and conclusion felt more political and reactionary. While I applaud their recognition of vaping and the need for testing, I also have to admonish their lack of care and due process. The FDA serves a critical role and I want them to take a very hard look at vaping. However, they must follow the scientific method to the letter if they are to fulfill their purpose. Given the potential significance of this to real tobacco users, and their fair and accurate treatment of this is literally life and death for millions." Brower's response was typical of many vaporizer owners - one of shock and disbelief at the knee-jerk public and governmental reaction. It is hard for them to see the logic in allowing the sale and use of tobacco cigarettes, which are proven to contain dozens of poisons and carcinogens and create second-hand smoke while attempting to ban the vaporizers, which were found, in the FDA's own research, to possibly only contain trace amounts of adverse ingredients. As Brower pointed out, those results were based on incomplete data collected from only a few samples - out of hundreds of different liquids and cartridges available on the market. Dr. Michael Siegel is a professor at Boston University School of Public Health and a physician who specialized in preventive medicine and public health. On his blog, The Rest of the Story: Tobacco News Analysis and Commentary, he commented, "With the FDA now approving the sale and marketing of conventional cigarettes, it is absurd to think that the Agency would spend so much of its energy on an attempt to remove this much safer alternative from the market, while ignoring the very real threat posed by the cigarettes being smoked by 45 million Americans." "While further testing of electronic cigarettes is certainly warranted, and while restrictions on the sales of these products to minors and the types of marketing claims that can be made are reasonable," Dr. Siegel stated, "it would be criminal to take these products off the market. Smokers who have found these products to be a life-saver, allowing them to stay off regular cigarettes, should be permitted to have the choice of continuing to use the product while more definitive studies are conducted." Other physicians seem to agree with his conclusions. Just a few days before she started using a personal vaporizer, Julie Williams of Manchester, TN had a blood pressure reading of 230/110 and her heart rate was elevated. "I was on medication but it wasn't working," she recalled. "Within a week of vaping and only smoking 2-3 cigarettes a day, all my numbers went down to normal ones. My primary care doctor and cardiologist both attribute the change to me stopping smoking and vaping [instead.] Both doctors are telling other patients about e-cigs." She said she has now quit smoking tobacco cigarettes altogether. "Both my primary care physician and my cardiologist are behind me 100% in my vaping. I even vape in the exam rooms while we discuss my ongoing treatments." Williams' doctors don't seem too concerned about alleged "second-hand vapor" either, unlike a few legislators and anti-smoking groups across the country, such as Suffolk County, NY, which, sponsored by Majority Leader Jon Cooper (D-Lloyd Neck), bans e-cigarette use in public spaces. "There is no substantial evidence that these devices do any harm to the user or bystanders around the user," argued Spike Babaian, of Long Island, NY, in a recent press release. Electronic cigarettes imported from China have grown in popularity during the past several years — and that has concerned federal regulators, in part, because so little is known about what is in them. Preliminary tests by the Food and Drug Administration show that e-cigarettes — battery-powered tubes that deliver a nicotine vapor instead of burned tobacco smoke — contain some of the same dangerous cancer-causing chemicals that traditional cigarettes do, but at lower levels. The samples also revealed quality-control issues. FDA Deputy Commissioner Joshua Sharfstein says consumers should beware. "Some products, which are marketed as exactly the same, have wildly variable amounts of nicotine in them," Sharfstein says. "One of the products has a poison in it — that is diethylene glycol. And what that indicates is that we don't really know much at all about the way these things are produced." Sharfstein says e-cigarettes are subject to FDA approval as a drug or medical device, much like nicotine patches, gum and inhalers — and therefore they are illegal until they are cleared. The government has blocked e-cigarettes at the border, but has stopped short of closing down domestic retailers. That means smokers can still find $40 to $100 starter kits at travel centers, mall kiosks and online. How To Regulate? The industry has sued the FDA, claiming it should not be regulated like a drug. Walt Linscott, an attorney for Smoking Everywhere — one of two major importers of electronic cigarettes, cigars and pipes — says the e-cigarette is a tobacco product. And it should be regulated as such. "It is a cigarette, and cigarettes inherent by their design and nature are not safe," Linscott says. But as the company engages in a legal battle with the government, its very own telemarketers could be presenting a different picture to consumers, including marketing claims online. A Smoking Everywhere representative making a sales pitch said the product had been approved as safe by the FDA. Linscott says that was a mistake that has been corrected. The general confusion over whether e-cigarettes are safe prompted Oregon to get two travel centers to stop selling them in that state. E-cigarettes have banned by Israel, Australia, Canada and Mexico. Should They Be Banned? Anti-smoking advocates, like John Banzhaf with Action on Smoking and Health, are putting pressure on the FDA to ban the products in the U.S. "If nothing is done to stop these and other similar products from being thrown on the market without any testing, without any guarantees, without disclosure or testing of ingredients, it basically opens the market to having smokers serve as guinea pigs," Banzhaf says. There is a split in the public health community over this question similar to the abstinence-only debate in sex education: whether to advocate that smokers switch to less harmful products, even if they are not completely safe. Boston University School of Public Health professor Michael Siegel says the FDA's recent consumer warning was misleading because the agency found low levels of carcinogens in e-cigarettes. "It is comparable to what is present in nicotine-replacement products, which are on the market, and, in fact, if you look at the actual levels of the carcinogens in electronic cigarettes, they're about 1,400 times lower than in Marlboros," he says. The FDA's Sharfstein, however, says it is premature to say e-cigarettes are safer until regulators know what is in them. "It just may be that these products could help some people quit smoking, in which case the manufacturers have the opportunity to come to the FDA and demonstrate that with data," he says. "It's their obligation to prove that in order to market to the American people." A federal judge in Washington, D.C., is holding a hearing later this month to determine just what their obligation is.

Why struggle to be grouped with a product vilified for killing millions of people each year? At least for Smoking Everywhere Inc., it would be a step up from having its product regulated as a drug. Smoking Everywhere distributes e-cigarettes, which can't be lit and don't have tobacco. They are battery-operated and contain cartridges filled with nicotine, flavor and other chemicals. The steel tube that is made to look like a cigarette turns nicotine and water into a vapor that is inhaled. Company representatives will be in Washington, D.C., on Aug. 17 for a hearing in federal district court to challenge the U.S. Food and Drug Administration, which wants e-cigarettes labeled as drug devices under its jurisdiction. The FDA has not approved e-cigarettes as safe and has seized shipments being imported into the country. Smoking Everywhere filed a lawsuit against the federal agency in April and sought a restraining order claiming that the FDA doesn't have the authority to control its products. "It is an electronic cigarette, and a cigarette is not designed to stop someone from smoking ... so practically speaking, it would not fall under the definition of a drug," said Walt Linscott, a lawyer for Smoking Everywhere. Smoking Everywhere and another e-cigarette company, NJoy, which is a plaintiff in the suit, have had about 50 shipments confiscated by the FDA, Linscott said. Smoking Everywhere imports all its cigarettes from China. With shipments not able to pass through U.S. Customs, its distributors will eventually run out, he said. The FDA asserts it is protecting consumers. Right now, it's unclear how e-cigarettes would affect users' health, said Judy Leon, an FDA spokeswoman. "It is important for the American people to know what is in electronic cigarettes in terms of the chemicals and the dose of nicotine," Leon said. In a court filing, the FDA proposes that e-cigarettes fall in the category of drug devices as defined in the Federal Food, Drug and Cosmetic Act. They are designed, the FDA argues, to help in the treatment of nicotine addiction, which some medical experts have labeled a disease. No matter how the companies market the product, e-cigarettes deliver nicotine, so the FDA has the authority to regulate them, Leon said. Smoking Everywhere claims that unlike nicotine gums and transdermal patches that the FDA regulates, its e-cigarettes are a safer alternative to smoking, not necessarily a means to quit smoking. "A regular cigarette has no therapeutic value. ... It's not designed to provide a health benefit. It's quite the opposite," Linscott said. David Drobes, a researcher who works in the Tobacco Research and Intervention Program at the Moffitt Cancer Center in Tampa, Fla.said that if e-cigarettes are not regulated now, the public may regret it later. "If history proves anything, it is that companies that say they offer safer cigarettes really don't have the data to support that," he said, referring to light cigarettes advertised to have less tar and nicotine, claims that health advocates say are misleading. The FDA announced July 22 that a laboratory analysis of e-cigarettes found that they contain carcinogens and toxic chemicals such as diethylene glycol, used in antifreeze. Matt Salmon, president of the Electronic Cigarette Association, criticized the report as too narrow in scope and for not including a peer review. "My personal feeling is that it was a lot more about public relations than public health," Salmon said. FDA Explains the Import Alert Process in Electronic Cigarette Company Suit

By William T. Koustas, Dara Katcher Levy, and John R. Fleder – On April 28, 2009, Smoking Everywhere, Inc. (“SE”) sued FDA to “stop FDA from improperly exceeding its delegated authority by attempting to regulate electronic cigarettes” to the extent that FDA declared such products to be a new drug and/or new drug device combination. (A copy of the complaint is available here.) SE further alleges that FDA exceeded its statutory authority by adding SE’s products to an FDA Import Alert list, thus allegedly preventing their admittance into the United States. In addition to the complaint, SE filed a temporary restraining order and preliminary injunction Motion. According to SE, an electronic cigarette essentially permits the user to inhale vaporized nicotine without smoke, tar or “cancerous by-products” normally produced with a cigarette. They do not claim it as a smoking cessation aid, but rather as an alternative to smoking cigarettes. FDA added electronic cigarettes to Import Alert 66-41 in early 2009. SE argues that FDA exceeded its authority in a March 2009 Notice of Action to SE which stated that electronic cigarettes are combination drug/device products that require FDA approval. SE submits that Congress has clearly indicated that FDA does not have the authority to regulate the non-therapeutic use of nicotine or its delivery systems. FDA v. Brown & Williamson Tobacco Corp., 529 U.S. 120 (2000). SE further contends that FDA lacks the authority to regulate electronic cigarettes because nicotine is not a drug. On May 11, 2009, FDA filed a brief in opposition to SE's Motion. FDA contends that electronic cigarettes are indeed both a drug and a device, and that Brown & Williamson does not exempt them from FDA’s jurisdiction. FDA argues that it has scientifically determined that nicotine has a psychoactive effect on the brain in such a way as to cause addiction as well as other physical issues. Additionally, FDA argues that some of SE’s promotional materials demonstrate that electronic cigarettes are intended to “prevent, treat, or mitigate the withdrawal symptoms of nicotine addiction,” specifically because SE claimed their product was a “healthier way” to consume nicotine. FDA also disputes SE’s claim that Brown & Williamson precludes FDA regulation of nicotine products in general, asserting that the Court based its determination that FDA lacks authority to regulate tobacco products because other laws set out a different statutory scheme for regulation of those products (i.e., Federal Cigarette Labeling and Advertising Act and the Comprehensive Smokeless Tobacco Health Education Act). However, FDA notes, electronic cigarettes are not traditional tobacco products as defined under those other laws, thus making Brown & Williamson inapplicable to electronic cigarettes. SE also argues that the inclusion of electronic cigarettes on Import Alert 66-41 is tantamount to a substantive rule, which required FDA to first use notice and comment rulemaking. In support, SE cites Bellarno Int’l Ltd. v. FDA, 678 F. Supp. 410 (E.D.N.Y. 1998) and Benten v. Kessler, 799 F. Supp. 281 (E.D.N.Y. 1992). Bellarno held that FDA violated the Administrative Procedure Act by issuing an Import Alert that left no enforcement discretion, thus making it a “substantive rule of general applicability…rather than a discretionary general statement of policy.” Benten also determined that an Import Alert issued by FDA was a substantive rule requiring notice and comment rulemaking because it was essentially a binding pronouncement that left no room for enforcement discretion. In its opposition brief, FDA distinguishes Import Alert 66-41 from the Import Alert at issue in Bellarno, asserting that the language used in Import Alert 66-41 permits districts to use their discretion when determining whether a product subject to the alert should be detained. FDA cites the language in the Bellarno import alert, “automatically” and “shall,” as creating a detention requirement, while the phrase “districts may detain . . .” from Import Alert 66-41 as allowing for district discretion. This parsing of words by FDA, as a practical matter, does not reflect the way that FDA personnel treats Import Alerts. In reality, FDA districts do not look at Import Alerts as mere "advice" that may or may not be followed based on district discretion. The concept of district discretion contradicts FDA’s stated reasons for the creation of the Import Alert system. In chapter 9-13 of its Regulatory Procedures Manual, FDA states that prior to the implementation of the Import Alert system, “coverage of imported products was often conducted on a district-by-district basis, resulting in less effective consumer protection.” In practice FDA relies upon the Import Alert system to identify problem commodities and/or shippers and/or importers and provide something more than mere "guidance" - something that results in more uniform enforcement actions against the specified products/shippers/importers mentioned in the alert.

First there was smoked tobacco. Then there was smokeless tobacco. Now there's something in between. It's vaporized nicotine, aka "vaping." It isn't quite tobacco, and it isn't quite smoking. Should we ban it, since it's sort of like smoking? Or should we tolerate it, since it's different in important respects? Does the war on smoking require total victory, or can we accept a peace deal that lets the industry, in some form, escape? Let's start with a bit of background. Vaporized nicotine has been around in various forms for at least two decades. Lately, it's been spreading across the world in the form of "electronic cigarettes." Two months ago, Slate's Emily Yoffe tried them out and reported: The e-cigarette contains no tobacco and produces no smoke. Instead, it is an ingenious electronic device. … The "filter" is a receptacle for nicotine suspended in propylene glycol—the main ingredient in deodorant sticks and artificial smoke machines. … When the user sucks on the filter, a nicotine-laced vapor is produced, satisfying a smoker's cravings. … [One product] allows you to choose filter cartridges with different levels of nicotine. I selected "none," which meant my e-cig was the buzz-free equivalent of nonalcoholic beer. The cigarette came in flavors such as tobacco, vanilla, mint, and apple. … Fortunately, as bad as the mist tasted, there was no noticeable odor, and it dissipated almost immediately, and thus didn't create a secondhand vapor problem.

The newly re-opened Duso's Bar is smoke-free, but that doesn't mean you have to go without nicotine. A new invention from China, and sold at Duso's, is offering smokers an alternative to traditional cigarette. Called a "Vaporette," the device is a cigarette replica containing a packet of liquid nicotine, without the flame, ash, tobacco, tar or carbon monoxide contained in traditional cigarettes. When a user inhales through the device's filter, air flow is detected by a sensor, activating a heating element vaporizing nicotine contained in the mouthpiece. Upon exhaling, the user releases a puff of quickly dissipating water vapor, resembling smoke. The Food and Drug Administration has not approved the device and considers it a drug. The agency is currently attempting to block importation of electronic cigarettes, but is not seizing products already sold in the U.S. Distributed locally by Bay City resident Penny Warner, the invention is sold exclusively at Duso's, 604 E. Midland St., in Bay City. Closed for 12 years, Duso's reopened as a smoke-free bar on March 20 and sells kits of Vaporettes as a smoking alternative. "I believe everyone has a choice in this nation," said Beth Dore, Duso's new owner. "Being a nonsmoker, I didn't feel I had a choice to go into a bar without smoke. Now there is a choice." "My son saw them on CNN and 60 Minutes," added Warner. "They're a big thing in California right now because everything is smoke-free. We ordered some and just started selling them in Bay City and they seem to be going pretty well." As Vaporettes are flameless and smokeless, users can puff on them in many nonsmoking areas, Warner said. Jeff LaBean, 47, is hoping the Vaporettes will help him quit smoking. The Bay City resident, who started on the Vaporettes this week, typically smokes a pack of cigarettes per day. Having purchased his Vaporettes at Duso's, he plans to use decreasing dosages of nicotine to taper off his habit. "So far, so good," LaBean described his experience with the electronic cigarette, adding it does satisfy his nicotine urge. "It doesn't stink, that's for sure." Life, health insurers invest big in tobacco

WASHINGTON (AFP) – Major US, Canadian and British life and health insurance companies have billions of dollars invested in tobacco companies, a study published Wednesday in the New England Journal of Medicine said. Wesley Boyd, the study's lead author, found that at least 4.4 billion dollars in insurance company funds are invested in companies whose affiliates produce cigarettes, cigars and chewing tobacco. "Despite calls upon the insurance industry to get out of the tobacco business by physicians and others, insurers continue to put their profits above people's health," said Boyd, a faculty member of Harvard Medical School. "It's clear their top priority is making money, not safeguarding people's well-being," he wrote. Tobacco is considered the leading cause of lung cancer and a major risk factor for heart attack, stroke, pulmonary disease and cancer. According to the World Health Organization, it is a contributing factor in 5.4 million deaths a year. Researchers first revealed that health and life insurance companies had major investments in tobacco companies in 1995 in an article in the British medical journal Lancet. "Although investing in tobacco while selling life or health insurance may seem self-defeating, insurance firms have figured out ways to profit from both," Boyd wrote. "Insurers exclude smokers from coverage or, more commonly, charge them higher premiums. Insurers profit -- and smokers lose -- twice over." According to the study, US insurer Prudential Financial Inc. has 264.3 million dollars invested among three US tobacco companies, including Reynolds America and Philip Morris. Canadian insurer Sun Life Financial Inc., which sells life, disability and health insurance, has a stock portfolio with more than one billion dollars in two tobacco companies, including 890 million dollars in Philip Morris. Prudential Plc, which sells health and disability insurance, has 1.38 billion dollars in two tobacco companies, including British American Tobacco. The study also details the substantial tobacco investments of the US firms Northwestern Mutual and Massachusetts Mutual Life, and the Scottish firm Standard Life Plc.
